Terms of Service

1. قبول الشروط

باستخدام موقع hmstar.net أو طلب أي خدمة من النجم الحديث للشحن، فإنك تقر بقراءة هذه الشروط والموافقة عليها. إذا كان الطلب مقدماً باسم شركة أو جهة، فأنت تقر بأن لديك صلاحية إلزامها بهذه الشروط.

قد تخضع بعض الشحنات إلى عرض سعر أو فاتورة أو اتفاق مكتوب يتضمن شروطاً إضافية. عند التعارض، تسري الوثيقة المكتوبة الخاصة بالخدمة في حدود ذلك التعارض.

2. نطاق الخدمات

قد تشمل خدماتنا استقبال وتجميع وتخزين البضائع في الصين، وترتيب الشحن البحري أو البري، ومتابعة النقل والموانئ، والتخليص الجمركي، والنقل إلى المستودع النهائي، وتتبع الحاويات، وخدمة العملاء والإشعارات الرقمية. يتحدد نطاق كل خدمة وفق عرض السعر أو الاتفاق أو بيانات الطلب المؤكدة.

يجوز تنفيذ جزء من الخدمة بواسطة ناقلين أو مستودعات أو وكلاء أو مزودي خدمات مستقلين.

3. بيانات العميل ومسؤوليته

يلتزم العميل بتقديم معلومات صحيحة وكاملة وحديثة، بما فيها الاسم ووسائل التواصل وبيانات المورد والفواتير ووصف البضاعة وكميتها وقيمتها ووزنها وأبعادها وأي متطلبات خاصة. يتحمل العميل النتائج والتكاليف الناتجة عن معلومات خاطئة أو ناقصة أو متأخرة.

يجب إخطارنا مسبقاً بالبضائع القابلة للكسر أو التلف، أو التي تتطلب تبريداً أو معالجة خاصة، أو التي تحتوي على بطاريات أو سوائل أو مواد كيميائية أو مغناطيسية أو أي عناصر خاضعة لقيود النقل.

4. البضائع المحظورة أو المقيدة

لا يجوز تسليم بضائع محظورة قانوناً أو خطرة أو مقلدة أو مجهولة المصدر أو غير مصرح باستيرادها أو تصديرها أو نقلها. ويحق لنا رفض الشحنة أو تعليقها أو إعادتها أو تسليمها للجهة المختصة إذا تبين أنها مخالفة أو تشكل خطراً، مع تحميل العميل التكاليف المترتبة عندما يسمح القانون بذلك.

موافقتنا المبدئية على استلام طرد لا تعني اعتماداً قانونياً نهائياً لمحتوياته أو مستنداته.

5. عروض الأسعار والرسوم والدفع

تحدد الأسعار والعملة ومدة صلاحية العرض وطريقة الدفع في عرض السعر أو الفاتورة. قد تتغير التكلفة إذا اختلف الوزن أو الحجم أو نوع البضاعة أو سعر الصرف أو رسوم الناقل والميناء والجمارك أو ظهرت خدمات إضافية لم تكن معلومة وقت التسعير.

ما لم يذكر خلاف ذلك، لا تشمل الأسعار الرسوم الجمركية أو الضرائب أو الغرامات أو رسوم الفحص أو الأرضيات أو التخزين أو إعادة التغليف أو التسليم الخاص. يجوز تعليق التسليم أو الخدمة عند وجود مبالغ مستحقة وفقاً للقانون والاتفاق.

6. التغليف والفحص والتأمين

العميل أو المورد مسؤول عن تغليف البضاعة بصورة مناسبة لطبيعتها ومسار النقل ما لم نتفق كتابياً على خدمة تغليف. يجوز لنا إعادة التغليف أو اتخاذ إجراء وقائي عند الضرورة، وقد تضاف تكلفته إلى حساب العميل.

لا يعد التأمين على البضاعة مشمولاً تلقائياً إلا إذا نص عرض السعر أو الاتفاق على ذلك. على العميل طلب التأمين والإفصاح عن القيمة الحقيقية قبل الشحن. وتخضع المطالبات التأمينية لشروط شركة التأمين والناقل والمستندات المطلوبة.

7. المواعيد التقديرية والتأخير

تواريخ التحميل والمغادرة والوصول والتخليص والتسليم، بما فيها التواريخ الظاهرة في صفحة التتبع، تقريبية وتقديرية وليست موعداً نهائياً مضموناً. قد تتغير نتيجة جداول السفن، الطقس، ازدحام الموانئ، التفتيش والجمارك، توفر النقل، الإغلاقات، القوة القاهرة، أو قرارات الجهات الرسمية.

نبذل جهداً معقولاً لتحديث الحالة وإبلاغ العميل بالتغييرات المهمة، لكن لا نضمن مدة نقل محددة إلا إذا ورد ضمان صريح ومكتوب في اتفاق خاص.

8. التتبع والمعلومات الرقمية

معلومات التتبع والإشعارات تقدم لتسهيل المتابعة، وقد تتأخر أو تتغير عند ورود بيانات جديدة من الناقل أو الوكيل أو الجمارك. لا تمثل حالة الموقع مستند ملكية أو إفراجاً جمركياً أو دليلاً نهائياً على التسليم ما لم تؤيدها المستندات الرسمية.

يحظر محاولة الوصول غير المصرح به إلى لوحة الإدارة أو واجهات API أو بيانات شحنات لا تخص المستخدم، أو تعطيل الموقع أو اختبار أمانه دون تصريح مكتوب.

9. الاستلام والتخزين

على العميل استلام البضاعة وسداد المبالغ المستحقة خلال المدة التي يتم إبلاغه بها بعد جاهزيتها. قد تترتب رسوم تخزين أو أرضيات أو مناولة على التأخر في الاستلام. وإذا استمر عدم الاستلام، يجوز اتخاذ الإجراءات التي يسمح بها القانون والاتفاق، بعد محاولات معقولة للتواصل.

يجب فحص الحالة الظاهرة للبضاعة عند الاستلام وإبلاغنا بأي نقص أو تلف ظاهر في أقرب وقت ممكن مع تقديم الصور والمستندات الداعمة. تخضع المطالبة أيضاً لمهل وشروط الناقل أو التأمين المعمول بها.

10. واتساب والاتصالات الإلكترونية

عند موافقة العميل على التواصل عبر واتساب أو البريد أو الهاتف، يجوز لنا إرسال تحديثات الشحنة، وإشعارات الوصول، وطلبات استكمال البيانات، ورسائل الدعم والأمان. قد يعتمد التسليم على توفر خدمات Meta أو مزود البريد وشبكة العميل، لذلك لا نضمن وصول كل رسالة فوراً.

يمكن سحب موافقة رسائل واتساب غير الضرورية بالرد بطلب الإيقاف أو مراسلة info@hmstar.net. تخضع معالجة البيانات إلى سياسة الخصوصية.

11. الحسابات والأمان

المستخدمون المخولون بلوحة الإدارة مسؤولون عن حماية بيانات الدخول وعدم مشاركتها والإبلاغ فوراً عن أي استخدام مشتبه به. يجوز لنا تعطيل أو تقييد حساب عند الاشتباه في اختراق أو إساءة استخدام أو مخالفة هذه الشروط.

12. حدود المسؤولية والظروف الخارجة عن السيطرة

نبذل عناية مهنية معقولة في تقديم الخدمات. وفي الحدود التي يسمح بها القانون، لا نتحمل خسائر غير مباشرة أو خسارة أرباح أو فرص تجارية، ولا التأخير أو الفشل الناتج عن ظروف خارجة عن سيطرتنا المعقولة، بما فيها الكوارث والطقس والحروب والاضطرابات والإغلاقات والأوبئة وأعطال الموانئ أو الناقلين والقرارات الحكومية.

تخضع مسؤولية فقد أو تلف البضائع، عند ثبوتها، للقانون وشروط الناقل والتأمين والاتفاق المكتوب الخاص بالشحنة. ولا يحد أي نص من مسؤولية لا يسمح القانون باستبعادها.

13. الملكية الفكرية والخدمات الخارجية

الموقع وتصميمه ومحتواه وشعاراته وبرمجياته مملوكة للنجم الحديث أو مرخصة لها. لا يجوز نسخها أو استخدامها تجارياً دون إذن. وقد يتضمن الموقع روابط أو تكاملات مع Meta وWhatsApp وFacebook وخدمات أخرى تخضع لشروط وسياسات مزوديها.

14. التعليق والإنهاء

يجوز لنا رفض أو تعليق أو إنهاء الخدمة عند عدم السداد، أو تقديم معلومات مضللة، أو الاشتباه في نشاط غير قانوني، أو تعريض الموظفين أو الأنظمة أو البضائع للخطر، أو مخالفة هذه الشروط. تبقى المبالغ والالتزامات التي نشأت قبل الإنهاء مستحقة.

15. القانون وتسوية النزاعات

تخضع هذه الشروط للقوانين المعمول بها في الجمهورية اليمنية، مع مراعاة أي قواعد إلزامية واجبة التطبيق. نسعى أولاً إلى حل النزاع ودياً من خلال التواصل المباشر. وإذا تعذر الحل، تختص الجهات والمحاكم المختصة في عدن ما لم يتفق الطرفان كتابة على إجراء آخر.

16. التحديثات والتواصل

يجوز تحديث هذه الشروط عند تغير الخدمات أو المتطلبات القانونية. يسري التحديث من تاريخ نشره، ولا يؤثر بأثر رجعي في اتفاق مكتوب قائم إلا وفق القانون أو بموافقة الأطراف.

1. Acceptance

By using hmstar.net or requesting a service from Modern Star Shipping, you confirm that you have read and agree to these Terms. If you act for a company or other entity, you confirm that you have authority to bind it.

A shipment may also be governed by a quotation, invoice, or written agreement containing additional terms. Where there is a conflict, the service-specific written document controls to the extent of that conflict.

2. Services

Our services may include receiving, consolidating, and storing goods in China; arranging sea or land transport; port and carrier coordination; customs clearance; final warehouse delivery; container tracking; customer support; and digital notifications. The confirmed quotation, order details, or written agreement defines the scope of each service.

Independent carriers, warehouses, agents, or other service providers may perform parts of the service.

3. Customer information and responsibility

You must provide accurate, complete, and current information, including contact details, supplier and invoice information, a truthful description of the goods, quantity, value, weight, dimensions, and special handling requirements. You are responsible for consequences and costs caused by inaccurate, incomplete, or late information.

You must disclose fragile or perishable goods, goods requiring refrigeration or special handling, batteries, liquids, chemicals, magnetic items, and anything subject to transport restrictions before delivery to us.

4. Prohibited and restricted goods

You must not submit illegal, dangerous, counterfeit, undocumented, or unauthorized goods. We may reject, suspend, return, or report goods that appear unlawful or unsafe and may charge resulting costs where permitted by law.

Initial acceptance of a package is not final legal approval of its contents or documents.

5. Quotes, charges, and payment

The quotation or invoice states the price, currency, validity period, and payment method. Charges may change if weight, volume, commodity type, exchange rates, carrier or port charges, customs costs, or required services differ from the information available when the quote was issued.

Unless expressly included, prices exclude customs duties, taxes, penalties, inspections, demurrage, storage, repacking, and special delivery. We may suspend service or delivery while amounts are overdue, subject to applicable law and the agreement.

6. Packing, inspection, and insurance

You or your supplier are responsible for packing goods appropriately for their nature and route unless a packing service is agreed in writing. We may repack or take protective action when reasonably necessary and charge the related cost.

Cargo insurance is not automatically included unless the quotation or agreement says otherwise. Insurance must be requested and the true cargo value disclosed before shipment. Claims remain subject to insurer and carrier terms and supporting document requirements.

7. Estimated dates and delays

Loading, departure, arrival, customs, and delivery dates, including dates shown in tracking, are approximate estimates and are not guaranteed deadlines. They may change because of vessel schedules, weather, port congestion, inspections, customs, transport availability, closures, force majeure, or official decisions.

We make reasonable efforts to update status information and communicate material changes, but no transit time is guaranteed unless an express written guarantee is included in a specific agreement.

8. Tracking and digital information

Tracking information and notifications are provided for convenience and may be delayed or revised when new information arrives from a carrier, agent, or authority. Website status is not a title document, customs release, or conclusive proof of delivery unless supported by official documents.

You may not access administration systems, APIs, or another customer's shipment data without authorization, disrupt the website, or test its security without written permission.

9. Collection and storage

You must collect goods and pay outstanding amounts within the notified period after they become available. Delayed collection may result in storage, demurrage, or handling charges. Continued failure to collect may lead to measures permitted by law and the agreement after reasonable contact attempts.

Inspect the apparent condition of goods on collection and report visible shortage or damage promptly with supporting photographs and documents. Carrier or insurance notice periods and claim conditions may also apply.

10. WhatsApp and electronic communications

When you consent to communication by WhatsApp, email, or phone, we may send shipment updates, arrival notices, requests for missing information, support messages, and security communications. Delivery depends on Meta, email providers, and customer networks, so immediate receipt of every message is not guaranteed.

You may withdraw consent to non-essential WhatsApp messages by replying with a stop request or emailing info@hmstar.net. Personal data is handled under our Privacy Policy.

11. Accounts and security

Authorized administration users must protect their credentials, avoid sharing them, and report suspected misuse promptly. We may disable or restrict an account where compromise, misuse, or violation of these Terms is suspected.

12. Liability and events beyond control

We use reasonable professional care in providing services. To the extent permitted by law, we are not liable for indirect loss, lost profit, or lost business opportunity, or for delay or failure caused by events beyond our reasonable control, including disasters, severe weather, war, unrest, closure, epidemic, carrier or port disruption, and government action.

Liability for proven cargo loss or damage is subject to applicable law, carrier and insurance terms, and the shipment-specific written agreement. Nothing excludes liability that cannot legally be excluded.

13. Intellectual property and third-party services

The website, design, content, logos, and software are owned by or licensed to Modern Star Shipping and may not be copied or commercially used without permission. Meta, WhatsApp, Facebook, and other external integrations remain subject to their providers' terms and policies.

14. Suspension and termination

We may reject, suspend, or terminate service for non-payment, misleading information, suspected illegal activity, danger to staff, systems, or cargo, or breach of these Terms. Charges and obligations arising before termination remain due.

15. Governing law and disputes

These Terms are governed by the applicable laws of the Republic of Yemen, subject to any mandatory rules that apply. We first seek an amicable resolution through direct contact. If unresolved, the competent authorities and courts in Aden have jurisdiction unless the parties agree otherwise in writing.

16. Updates and contact

We may update these Terms when services or legal requirements change. An update applies from its publication date and does not retroactively alter an existing written agreement except as permitted by law or agreed by the parties.
